SCS/HB 795 - This act permits certain documents to be kept in an electronic format by the Department of Revenue and by the County Recorder of Deeds.

DEPARTMENT OF REVENUE - An electronic record of ownership or lien is deemed an original record when outputed in a clear, accurate and nontransient form. It is also deemed admissible as evidence in courts and administrative agencies.

A lienholder may elect to have the Director retain possession of the electronic record of ownership. Procedures for subordinate ownership and assignment are set forth.

The Director shall establish security procedures regarding electronic records. The Director shall issue regulations for retaining the certificate of ownership.

RECORDER OF DEEDS - This act permits a recorder of deeds to establish an electronic format for the recording or filing of documents. Documents submitted electronically need not be submitted in duplicate.

This act also allows the recorder to accept credit card payments on prepaid accounts.
