SCS/HS/HCS/HB 460 - This act requires the testing for communicable diseases, specifically hepatitis, B, C, HIV and tuberculosis, without the right of refusal, of an individual who has exposed a peace officer, reserve officer or emergency health care worker to blood or other bodily fluids. Any refusal to comply with the act will result in a Class B misdemeanor. Prior to testing, an individual should be informed of his or her right to a hearing. Disclosure may be made only to the individual tested, the parent or guardian of the individual, if a minor, the law enforcement officer or emergency health care worker and their employers, and the correction facility, if the individual is incarcerated. Results of the testing shall not be used as evidence in any court proceeding except for a prosecution of the individual for unlawfully transmitting HIV.
