HB 0321 Changes representation on governing bodies of public colleges and universities

HCS/HBs 321 & 493 - STUDENT REPRESENTATIVES - The act allows the student representatives to the governing boards of the University of Missouri, all state colleges and universities and Lincoln University to attend all meetings of the governing board. Currently, student representatives are to be excluded from any closed meeting, vote or record of the governing board. Such student representatives shall receive the same reimbursement of expenses as is provided to Curators.

This portion of the act is similar to SB 238 from 1999.

FACULTY REPRESENTATIVES - This act establishes faculty representatives to the governing boards of the University of Missouri, Lincoln University, Truman State University and the state four-year universities and colleges. The nonvoting faculty representative shall be appointed by the Governor for a term of two years from a list of three names provided by the faculty organization. The act provides for a single faculty representative to the Board of Curators of the University of Missouri, appointed on a rotating basis from each of the four campuses.

This portion of the act is similar to SB 625 from 1999.

GOVERNING BOARD CONFIDENTIALITY - Confidentiality requirements of governing boards of state colleges and universities shall apply to both voting members and nonvoting representatives. Any member or representative may recuse himself from any deliberation or proceeding of the board. A student representative may be excluded from a closed meeting of the board upon a unanimous affirmative vote of the voting members present at the meeting.

GOVERNING BOARDS OF CERTAIN STATE COLLEGES AND UNIVERSITIES - This act revises the requirements for selection of governing board members for Central Missouri State University (CMSU), Southwest Missouri State University (SMSU) and any other state college or university which has a statewide mission established pursuant to Section 173.030, RSMo. For the governing board of each such institution, the act does the following:

1) Eliminates the non-voting, out-of-state members;

2) Removes the limit that no more than one of the four members appointed from within the school's historic service region may be appointed from any one county, but provides that no more than two members may be appointed from a county with a population under 200,000; and

3) Removes the limit that no more than one of the three members appointed from outside the school's historic service region may be appointed from any one congressional district.

This portion of the act is similar to SCS/SB 218.

This act is similar to SS#2/HCS/HB 889.
