SCS/HB 1907 - This act clarifies that a health care provider's duty to conduct employee criminal background checks is satisfied by inquiry to the Highway Patrol for criminal records that are available for disclosure. Completion of the background check under Section 660.317 does not exempt an employer from further inquiry to satisfy common law requirements of exercising due diligence in hiring decisions. Applicants who knowingly fail to disclose their criminal history are guilty of a Class A misdemeanor. The Department of Social Services may waive hiring restrictions for good cause.
