HCS/HB 1737 & 1345 - This act authorizes the disclosure of information about current or past employees to new or prospective employers. The same information is available upon request to any former employee who is employed for at least 90 days. The employer may disclose: dates of employment; pay; job description; wage history; and conditions of separation from the employer's service. A copy of any information disclosed by the employer must be sent to the employee.

Any employer who discloses the information described above is immune from civil liability, unless the employer's response is shown to be false and made with knowledge that it was false or with reckless disregard for whether such response was true or false at a time when the employer had serious doubt whether such response was true.

All letters issued pursuant to this act shall not be allowed as evidence in an unemployment compensation claim.

This act is nearly identical to SCS/SBs 763 & 520 (1998) and SS/SB 147 (1997).
