SCS/HCS/HB 1684 - This act establishes the Family Care Safety Act that provides criminal background information on child care workers, elderly care workers, and care providers. Summer camps and voluntary associations designed for recreation or education are not included within the definition of "providers". Family members providing care for an immediate family members are also exempt from these provisions.

A "Family Care Safety Registry and Access Line" is to be established by the Department of Health (Department) to provide information regarding child care and elderly care workers. Those required to register but failing to register for good cause, are guilty of a Class B misdemeanor. Those not required to register may voluntarily do so.

The Department of Health shall maintain a toll free Family Care Safety Telephone Access Service to allow the public to access certain registry information. The Department may only confirm whether an individual is listed in the registry. Anyone who misuses information obtained from the access line is guilty of a Class A misdemeanor.

The Department shall collaborate with the Departments of Corrections, Public Safety, and Social Services in comparing background check information. The act requires the Department to submit an annual report by July 1 of each year regarding the operation of the access line and the registry.

The act allows elder care providers to access the Family Care Safety Registry in lieu of the registration requirements established pursuant to Section 660.317, RSMo.

This act is similar to SB 475 and SCS/SB 565.
