HB 1369 - Under current law, persons assisting an official oil spill response are not liable for removal costs or damages from actions taken in the oil spill response except in cases of willful misconduct, negligence, personal injury, or wrongful death. This act extends this liability protection to cases of negligence. Current law provides that the party responsible for the spill is liable for any removal costs or damages that any person is relieved of under these provisions. The act shall not limit a person's right to seek recovery of damages or costs from the Federal Oil Spill Liability Trust Fund.
