HB 1037 - Currently, any changes in ownership or operation of a dealership for farm implements, industrial maintenance and construction power equipment or outdoor power equipment must be approved by the applicable manufacturer, wholesaler or distributor. This act requires the determination to occur within 90 days of the request by a dealer to sell or transfer any portion of ownership to third party, or a request to enter into an operation agreement with another party.

The dealership must provide reasonable financial information, personal background, character references, and work histories as may be required by the manufacturer to make the determination. Should the request be deemed unacceptable, the manufacturer or distributor is to provide a written notice of the decision stating the reasons for nonacceptance.
