SB 1168 - This act modifies the duties of the State Mental Health Commission to include a focus on accessibility of services to promote timely treatment in the most efficient and efficacious setting of patients with mental illness, mental disorders, intellectual disabilities, and developmental disabilities. The Commission shall oversee and implement a collaborative project to: (1) assess the incidence and implications of foster children and clients of the Division of Developmental Disabilities who remain hospitalized without medical justification because appropriate post-discharge placement options are unavailable; (2) assess the incidence and implications of foster children with mental illness, mental disorders, intellectual disabilities, or developmental disabilities who remain hospitalized without medical justification awaiting screening for appropriateness of residential services; and (3) develop recommendations for the Director of the Department of Mental Health for ensuring treatment of such patients in the most cost effective and efficacious settings in the least restrictive environment.

The project shall be conducted as described in the act and in accordance with the timelines for reporting as set forth in the act, culminating in a final report submitted by December 1, 2023. Provisions of this act shall expire on September 1, 2024.
