Introduced

SB 329 - This act specifies that if a provision of a federal law, rule, or regulation relating to the availability or pricing of, or the coverages or scope of coverages provided by, private health insurance in this state is overturned or rendered unenforceable by a federal court, the provision shall remain in effect with regard to policies insuring residents of this state until such time as the General Assembly specifically provides otherwise.

This act applies only to federal provisions applicable to health carriers and in effect on January 1, 2021.

For purposes of a market conduct examination by the Department of Commerce and Insurance, a violation of federal law, rule, or regulation remaining in effect under the act shall be deemed a violation of state law.

This act contains an emergency clause.

This act is similar to SB 970 (2020) and HB 2507 (2020).
