House Amendment

HCS/SCS/SB 177 - This act modifies provisions relating to public health policies.

TAX EXEMPTION FOR CERTAIN DRUGS (Section 144.030)

The act modifies provisions of the current state and local sales and use tax exemption for sales of over-the-counter and nonprescription drugs to individuals with disabilities by requiring such items to be dispensed as prescribed by a practitioner and expands current state and local sales and use tax exemptions to include diabetic accessories and supplies, the rental of certain medical equipment including scooters and wheelchairs.

This provision is substantially similar to a provision in SS/SCS/HCS/HB 116 & 316 (2011).

VOLUNTEER HEALTH SERVICES ACT (Sections 191.100 to 191.1112)

This act establishes the Volunteer Health Services Act which allows a licensed health care provider to provide volunteer professional health care services for a sponsoring organization. Any person with a suspended or revoked license or who provides services outside the scope of his or her license is not eligible to provide services under the act.

Before a health care professional can provide volunteer services, the sponsoring organization shall register with the Department of Health and Senior Services and pay a $50 fee. A sponsoring organization shall file a quarterly voluntary services report with the department, keep its records of health care provider volunteers up to date, and maintain the records for five years following the service rendered by the health care provider volunteer.

An insurer providing professional liability coverage to a health care provider on or after August 28, 2011, cannot exclude coverage to a health care provider who volunteers his or her health care services if the sponsoring organization and the health care provider comply with the provisions of the act. Any health care provider volunteering his or her services shall not be liable for any civil damages for any act or omission resulting from his or her service unless there was gross negligence or willful misconduct. A volunteer cannot receive any form of direct or indirect compensation, benefits, or consideration for his or her health care services. The volunteer shall perform acts within the scope of his or her professional license and in compliance with all applicable health care regulations. Any volunteer crisis response team member who participates in a crisis intervention shall not be liable in tort for any personal injuries or emotional distress of any participant to the intervention that is caused by the act or omission of the team member during an intervention with certain specified exceptions.

These provisions are identical to HCS/HB 29 (2011).

MO HEALTHNET DENTAL BENEFITS (SECTION 208.240)

The MO HealthNet Division within the Department of Social Services, or a contractor of the division, is authorized to implement a statewide dental delivery system to ensure participation of and access to providers in all areas of the state. The division may administer the system or seek a third party experienced in the administration of dental benefits to administer the program under the supervision of the division.

This provision is identical to a provision in HB 579 (2011) and substantially similar to HB 201 (2011).

FOOD STAMPS ELIGIBILITY FOR CONVICTED FELONS (Section 208.247)

This act provides that pursuant to the option granted under the federal Personal Responsibility and Work Opportunity Act of 1996, an individual who has a felony conviction under federal or state law involving possession or use of a controlled substance shall be eligible for food stamp benefits if such person, as determined by the department of social services, successfully participates in or has satisfactorily completed a substance abuse treatment program approved by the Division of Alcohol and Drug Abuse or complies with all obligations imposed by the court, Division of Alcohol and Drug Abuse and the Division of Probation and Parole. The individual must all meet all other factors for foods stamps eligibility.

This provision is identical to HB 74 (2011) and HB 509 (2011).

MENTAL HEALTH EARNINGS FUND (Sections 630.053 and 630.095) This act provides that subject to appropriations, the proceeds earned from the sale of Mental Health First Aid USA services shall be directed to the Mental Health Earnings Fund. Such proceeds shall be used for the purpose of funding Mental Health First AID USA activities and shall be accounted for separately from all other revenues deposited in the fund.

This provision is identical to provisions in SCS/HCS/HB 555 (2011) and HB 557 (2011).

DEPARTMENT OF MENTAL HEALTH INVESTIGATIONS (Section 630.167)

This act also updates a statutory reference to reflect that Department of Mental Health investigative reports are automatically admissible in any hearing before the Administrative Hearing Commission.
