House Amendment

HCS/SCS/SB 242 - The act prohibits the Metropolitan Sewer District (MSD) from charging any property owner a fee for stormwater services if MSD does not directly providing sanitary sewer service to the property and does not handle stormwater runoff from the property or does not plan to handle the stormwater runoff within 18 months.

The act provides an alternate procedure to approve the issuing of bonds for a common sewer subdistrict that is partially or completely located in Cass County. Bonds may be issued for such a subdistrict if the subdistrict receives the written assent of 75% of the political subdivisions that do business with the subdistrict.

The act contains an emergency clause for the bond section.

HA 1 - THE AMENDMENT MODIFIES THE MSD LANGUAGE BY LIMITING THE TYPE OF REAL PROPERTY TO ONLY PROPERTY USED FOR RESIDENTIAL PURPOSES AND REMOVES THE PROVISION REGARDING PLANNED FUTURE HANDLING OF STORMWATER WITHIN THE NEXT 18 MONTHS.

THE AMENDMENT ALSO ADDS A PROVISION PROHIBITING A CITY OF THIRD CLASSIFICATION FROM IMPOSING A STORMWATER USAGE FEE ON PROPERTY OWNED BY CHURCHES, PUBLIC SCHOOLS, NONPROFIT ORGANIZATIONS, OR POLITICAL SUBDIVISIONS.
