SCS#2/SB 155 - This act modifies reporting requirements for child abuse and neglect initiated by a person required to report and requires the Division to maintain identifying information for five years from the conclusion of the investigation. Additionally this act changes the time period for maintaining identifying information for all other reports with insufficient evidence of abuse or neglect to two years from the conclusion of the investigation.

There are provisions for the Division of Family Services to expunge the information from reports against mandatory reporters when the report was found to be malicious, for purposes of harassment, or in retaliation forty-five days after the conclusion of the investigation. Additionally, the act includes the same provisions (expunge the information after 45 days in the case of malicious, harassment or retaliatory reports) for all other reports filed - not just for those filed against mandatory reporters.

For all other reports where insufficient evidence of abuse or neglect is found by the division, identifying information shall be retained for two years from the conclusion of the investigation.
