HB 1428 - This act authorizes the construction of a permanent memorial on the Missouri Capitol grounds for workers injured or killed on the job in Missouri.

The act establishes the Workers Memorial Committee and specifies the composition of the committee. The Committee is responsible for organizing a competition for the design of the memorial. Members of the Committee will not be compensated but will be reimbursed for actual and necessary expenses in the performance of official duties. A Workers Memorial Fund is also established in the State Treasury. The State Treasurer will invest moneys in the fund in a manner similar to other state funds. Interest accruing to the fund and moneys in the fund will not revert to general revenue. This portion of the act is similar to SB 709.

The act also revises child labor law pertaining to sporting events. Current law defines the term "employ" for the purpose of limiting child labor, and that definition includes an exception which allows any child 12 years of age and older to participate, in various ways, in a youth sporting event for compensation. This provision only applies to events where all of the players are under 18 years of age and the event is sponsored or supervised by a public body or not-for-profit entity.

The act removes compensation as a "player" from the list of activities which children aged 12 years or more may engage in under this exemption from "employ", thereby subjecting any child age 12 years or more who receives compensation for playing youth sports to the child labor restrictions of Chapter 294, RSMo. This portion of the bill is similar to SB 734.
