SCS/HB 1097 - This act provides civil immunity for any person owning land adjoining a stream or river for injuries to persons trespassing on the land, under certain circumstances. There is an exception for intentional or negligent, willful or wanton acts of the landowner.

Currently, a landowner may receive treble damages from a person who injures any tree or timber or certain other items found on the land of another person. The act includes governmental entities as landowners, and provides that the owner need not prove negligence or intent.
