Current Bill Summary

SB 993 - This act creates the Child Support Assurance Program within the Department of Social Services. Subject to appropriation, the Program shall provide monthly benefits to assure a reasonable standard of living to children who meet eligibility requirements. The Department shall determine the level of benefits based upon funds appropriated for the Program, among other factors.

In order to qualify for the program, the custodial parent shall be employed and have an income below poverty level, and an order for the noncustodial parent to pay child support must exist. Participation in the program is voluntary. When a custodial parent becomes employed after receiving a cash grant from the Department, child support assurance shall be initiated for the children.

The act allows the State to reduce child support assurance payments on a pro rata basis if the Department has insufficient funds to pay the full amount. The act also grants rulemaking authority to the Department to administer the section.

SCA 1 - ADDS A PROVISION THAT THE LEVEL OF BENEFITS PROVIDED TO PARTICIPANTS MAY NOT EXCEED THE AMOUNT OF THE COURT ORDERED CHILD SUPPORT. ADDS AN EXPIRATION DATE OF AUGUST 28, 2004.
