HS/HCS/SS/SB 549 - This act creates the Missouri Tobacco Settlement Trust Fund. All moneys received by the state as a result of any dispute between the state and tobacco companies shall be deposited in the Fund. Moneys in the Fund shall not revert to the credit of general revenue at the end of the biennium. The General Assembly shall not appropriate money from the Fund until a constitutional amendment is adopted by vote of the people, or January 3, 2001, which occurs sooner.

The Commissioner of Administration shall maintain data on electronic format regarding deposits to and expenditures from the Fund, which shall be available to the public on the Internet.

No moneys in the Fund shall be used to subsidize abortion services, directly or indirectly. No expenditures from the Fund may be paid to organizations or affiliates of organizations that perform, assisting with or directly refer for abortion, or encourage or counsel patients to have abortions. An exception is made for affiliates that are totally independent, separately incorporated and do not share the same or similar name, expenses, facilities, salaries, equipment or supplies.

The act has an emergency clause.

HA3 - INCORPORATES THE PATENT AND INTELLECTUAL PROPERTY PROVISIONS OF THE BAYH-DOLE ACT.

HA4 - GENERAL ASSEMBLY MAY AUTHORIZE SALE OF STATE'S FUTURE INTEREST IN SETTLEMENT PROCEEDS FOR PRESENT VALUATION.

HA6 - 1 PERCENT OF FUND SHALL BE APPROPRIATED TO DEPARTMENT OF AGRICULTURE, TO SUPPORT TOBACCO GROWERS. 1.5 PERCENT SHALL BE DEPOSITED IN THE NEW GENERATION COOPERATIVE INCENTIVE PROGRAM.

HA7 - "ABORTION" EXCLUDES ABORTION NECESSARY TO SAVE LIFE OF MOTHER.

HA8 - 15 PERCENT OF FUND SHALL BE TRANSFERRED MONTHLY TO DEPARTMENT OF MENTAL HEALTH TO ASSIST RESIDENTS WITH DEVELOPMENTAL DISABILITIES.

HA9 - 5 PERCENT OF FUND SHALL BE TRANSFERRED ANNUALLY TO THE CANCER TREATMENT TRUST FUND, FOR ELLIS FISCHEL STATE CANCER HOSPITAL.

HA10 - 75 PERCENT OF MONEYS ALLOCATED IN CESSATION AND PREVENTION PROGRAMS SHALL BE USED FOR POPULATION MOST AFFECTED BY TOBACCO ILLNESSES.

HA11 - FUND SHALL NOT BE APPROPRIATED UNTIL CONSTITUTIONAL AMENDMENT "ADOPTED"; DELETES "VOTED ON".

HA12 - NO MONEYS SHALL BE APPROPRIATED TO ANY COMPANY THAT CONSISTENTLY ENGAGES IN PRICE DISCRIMINATION TO SUBSIDIZE FOREIGN COMPETITORS.

HA14 - 1.5 PERCENT OF FUND SHALL BE APPROPRIATED TO DEPARTMENT OF AGING TO PROVIDE SERVICES FOR SENIOR CITIZENS.

HA15 - 15 PERCENT OF FUND SHALL BE APPROPRIATED TO CITY OF ST. LOUIS FOR ROADS, BRIDGES AND HIGHWAYS.

HA16 - 10 PERCENT OF INTEREST IN FUND SHALL BE TRANSFERRED MONTHLY TO DEPARTMENT OF HEALTH TO REMOVE TARTER STAINS OF STATE'S CHILDREN AND OTHER DENTAL PROBLEMS CREATED BY TOBACCO.
