Current Bill Summary

SB 956 - This act revises the procedures for the towing of abandoned vehicles or other property from private property.

The authorization to tow may be given by a property manager. Immediate towing may be made from "restricted or assigned" areas as long as a proper sign is posted. The act removes the requirement for a notice to a law enforcement agency prior to the tow.

An abandoned property report shall be completed at the time of the tow; the form of the report is revised. The towing company shall deliver the report to the local law enforcement agency, and that agency shall promptly provide the towing company with the latest owner and lienholder information. If the property is not claimed within 10 days, the towing company shall send a copy of the report to the Department of Revenue. The penalty for wrongful removal of the property is expanded.
