FISCAL ANALYSIS

ASSUMPTION

Officials of the Missouri Department of Transportation, Missouri Sheriffs' Association, Department of Public Safety - Missouri State Highway Patrol, State Courts Administrator and the Office of the Attorney General assume there would be no fiscal impact to their agencies.

Officials of the Department of Revenue (DOR) assume their department would incur expenses to revise procedures manuals and to inform towers of their new responsibilities. DOR staff they would incur $2,601 in FY99 to implement this proposal. Oversight assumes these costs could be absorbed within existing resources.

Officials of the Missouri Police Chiefs' Association have not responded to the request for fiscal impact; however, in response to similar proposals they have assumed there would be no fiscal impact to their agency.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION

This proposal would revise the procedures for the towing of abandoned vehicles or other property from private property.

The authorization to tow could be given by a property manager. Immediate towing could be made from "restricted or assigned" areas as long as a proper sign was posted. The proposal would remove the requirement for a notice to a law enforcement agency prior to the tow.

This proposal would require an abandoned property report to be completed at the time of the tow; the form of the report would be revised. The towing company would be required to deliver the report to the local law enforcement agency, and that agency would be required to promptly provide the towing company with the latest owner and lienholder information. If the property was not claimed within 10 days, the towing company would send a copy of the report to the Department of Revenue. This proposal would expand the penalty for wrongful removal of the property.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
