House Approves Access to Justice Bills Initiated By Sen. Bob Dixon
 

JEFFERSON CITY — Yesterday (4-15), the Missouri House of Representatives approved companion bills to Senate Bill 21 and Senate Bill 22, sponsored by Sen. Bob Dixon, R-Springfield. Sponsored by Rep. Stan Cox, R-Sedalia, and handled by Rep. Kevin Elmer, R-Nixa, HBs 374 & 434 would authorize the Missouri Supreme Court to transfer judicial positions from one circuit to another when vacancies occur, while HBs 373 & 435 would authorize the Supreme Court to redraw judicial circuit boundaries on a regular basis.   

 

“I filed the original Senate bills to address a developing problem before it grows out of control,” said Sen. Dixon. “Justice delayed is justice denied. In Greene County — and throughout the state — I want to make sure the courts can meet the demands placed on them, so citizens have their day in court, as our constitution requires.” 

 

Currently, the General Assembly is responsible for drawing judicial circuit boundaries, determining where judicial positions are needed, and authorizing judicial positions in specific circuits. HBs 374 & 434 and HBs 373 & 435 (and their companions SB 21 and SB 22) would delegate to the Missouri Supreme Court the ability to transfer judicial positions under certain circumstances and redraw judicial circuit boundaries on a regular basis. When a judge retires, a judicial position could be moved from one circuit to another circuit, after several factors are taken into consideration. Redistricting of legislative districts happens every decade, nationwide, to account for population shifts. In contrast, the General Assembly hasn't redrawn Missouri's judicial circuits statewide since 1959. 

 

“Keeping our courts open and administering justice efficiently and effectively are core functions of state government,” said Sen. Dixon. “These bills provide greater flexibility in tight fiscal times, allowing the judiciary to make the best use of its existing resources where they are needed most. At the same time, ultimate responsibility still rests with elected representatives in the General Assembly.”
