ASSUMPTION



Officials from the Department of Public Safety - Missouri Highway Patrol and the Director's Office and the Department of Economic Development - Division of Motor Carriers and Railroad Safety each assume no fiscal impact from the proposal.



Officials from the Department of Transportation (DHT) state this legislation gives railroad policemen as commissioned by the superintendent of the Patrol authority to act as peace officers. Since under sections 388.600 and 388.635 RSMo.2000, railroad police are employees of railroads, this legislation will have no fiscal impact on MHTC.

No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION



This proposal requires that railroad policemen be commissioned by the Superintendent of the Missouri State Highway Patrol. "Commission" means a grant of authority to act as a peace officer.



This proposal requires all railroad policemen employed after September 28, 1971, shall be a licensed peace officer in accordance with the provisions of Chapter 590, RSMo.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
