ASSUMPTION
Officials from the Department of Health and Senior Services, Department of Economic Development - Division of Professional Registration and Office of State Courts Administrator assume the proposed legislation will not fiscally impact their organizations.
Officials from the Office of Administration - Division of Budget and Planning (BAP) stated the proposed legislation should not result in additional costs or savings to the BAP. However, the proposed legislation may increase total state revenue.
Officials from the Office of the Secretary of State (SOS) state this bill requires further accountability of first responders and emergency medical technicians. The Department of Health and Senior Services may promulgate rules to implement this legislation. Based on experience with other divisions, the rules, regulations and forms issued by the Department of Health and Senior Services could require as many as 6 pages in the Code of State Regulations. For any given rule, roughly one-half again as many pages are published in the Missouri Register as are published in the Code because cost statements, fiscal notes and notices are not published in the Code. The estimated cost of a page in the Missouri Register is $23.00. The estimated cost of a page in the Code of State Regulations is $27.00. The actual costs could be more or less than the numbers given. The fiscal impact of this legislation in future years is unknown and depends upon the frequency and length of rules filed, amended, rescinded and withdrawn. The SOS estimates the cost of this legislation to be $369 [(6 pp x $27) + (9 pp x $23)].
Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple bills pass which require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process. Any decisions to raise fees to defray costs would likely be made in subsequent fiscal years.
Officials from the Department of Corrections (DOC) stated the DOC cannot predict the number of new commitments which may result from the creation of the offense(s) outlined in this proposal. An increase in commitments depends on the utilization by prosecutors and the actual sentences imposed by the court.
If additional persons are sentenced to the custody of the DOC due to the provisions of this legislation, the DOC will incur a corresponding increase in operational cost either through incarceration (FY 01 average of $35.78 per inmate per day, or an annual cost of $13,060 per inmate) or through supervision provided by the Board of Probation and Parole (FY 01 average of $3.34 per offender per day, or an annual cost of $1,219 per offender).
ASSUMPTION (continued)
Supervision by the DOC through probation or incarceration would result in additional unknown costs to the DOC. Eight (8) persons would have to be incarcerated per fiscal year to exceed $100,000 annually. Due to the narrow scope of this new crime, it is assumed the impact would be less than $100,000 per year for the DOC.
The proposed legislation may result in an increase in Total State Revenue.

FISCAL IMPACT - Small Business
The proposed legislation may have a minor fiscal impact on small businesses that employ first responders as they will be required to display proof of completion of courses taken by employees.
DESCRIPTION
This act requires further accountability of first responders and emergency medical technicians (EMT).
Current law defines "first responders" and requires them to complete a course. This act requires a first responder to display proof of completion of that course in plain view of clients of the emergency medical response agency for which the first responder works (Section 190.092).
DESCRIPTION (continued)
Current law also outlines requirements for the issuance of an EMT license and prohibits the representation of one's self as an EMT without a license. This act provides for a Class C felony for violation of licensure requirements upon each offense. This act also provides for a Class A misdemeanor for any individual who employs a person who violates licensure requirements (Section 190.142).
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
