FISCAL ANALYSIS



ASSUMPTION



Officials from the Missouri Department of Conservation, the Department of Economic Development - Division of Professional Registration, the Department of Social Services, the Department of Insurance, the Department of Transportation, the Missouri Consolidated Health Care Plan, the Department of Health and Senior Services, the Department of Mental Health, and the Department of Public Safety - Missouri State Highway Patrol assume this proposal would not fiscally impact their agencies.



Officials from the Department of Corrections (DOC) state that DOC already meets the standard proposed in this legislation by having computerized medical records. DOC states printing out records may prove to have some fiscal impact for the DOC, however it is assumed to be a minimal amount that could be absorbed within existing resources.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal requires physicians to maintain adequate and complete medical records for their patients. Such records shall include identification of the patient, appointment dates, current status, observations, diagnosis, plan for treatment including prescriptions, and record of consent. Records must be maintained for at least seven years. Changes to records which occur forty-eight hours after the last entry must be noted. A consultative report will be adequate for certain persons. The Board of Registration for the Healing Arts may not discipline a person solely for violation of this section. Finally, the Board may not obtain a patient's medical record without the patient's written consent or a subpoena.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
