ASSUMPTION



Officials from the Department of Elementary and Secondary Education and the Office of Secretary of State - Elections indicated this proposed legislation would have no fiscal impact on their agencies.



Officials from the Poplar Bluff R-I School District stated they would see no loss or gain to their school district as a result of this proposal. They indicated that while it clarifies the procedure, it has no financial implications. The only loss or gain to a district would be property actually changed from one district to another, resulting in a loss of assessed valuation, local taxes, and pupils for one district and a gain for the other district.



Responses were not received from the following: Butler County Clerk, Marion County Clerk, Hannibal Public Schools, Christian County Clerk, Nixa R-II School District

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposed legislation applies standards to be utilized by the Board of Arbitration in determining whether a proposed school district boundary change is necessary. The standards for such a determination include the presence of: school-aged children in the affected area; actual educational harm to school-age children (significant differences in transportation time or educational opportunities); an educational necessity, not a commercial benefit to landowners.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
