ASSUMPTION
Officials with the Department of Revenue (DOR), the Department of Transportation (MoDOT), and the Department of Economic Development (DED) assume the proposal has no fiscal impact on their agencies.
Officials with the Office of the Secretary of State (SOS) assume the proposal will require the Missouri Department of Highways and Transportation to amend their existing rules and regulations as they pertain to issuance of certain types of permits and certain restrictions on weight and width of specific vehicles utilized to haul lumber products and earth moving equipment. Any revised, amended or new proposed rule-making must, by statute, be published in the Missouri Register and the Code of State Regulations.
Based on prior regulations, these agencies' rules and forms could require as many as 3 pages in the Code of State Regulations. Because rules in their proposed version are also published in the Missouri Register, one and one-half again as many pages (4.5 pages) will be required to be published in this publication because cost statements, fiscal notes, etc., are not republished in the Code. The cost per page of text in the Missouri Register is $23.00, thereby yielding a total cost of $104 ($23 x 4.5). The cost per page in the Code of State Regulations is $27.00, thereby yielding a total cost of $81 ($27 x 3). The total cost incurred by the Secretary of State would then be $185 ($104 + $81). All of the previous costs are estimated. The actual cost could be more or less than the estimate provided.
Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple bills pass which require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process. Any decisions to raise fees to defray costs would likely be made in subsequent fiscal years.

FISCAL IMPACT - Small Business
A direct fiscal impact to small businesses would be expected as a result of this proposal. Businesses that haul earth moving equipment and lumber products will be able to secure permits that allow movement of these products having widths greater than the present statute limits of 14 feet wide. These types of moves will be treated in the same fashion and held to the same standards as other permit requests.
DESCRIPTION
This proposal exempts vehicles hauling lumber and earth-moving equipment, not in excess of fourteen feet in width, from the requirement of obtaining special permits issued upon proper application that allow movement along state and federal highways.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
