ASSUMPTION
Officials of the Office of the State Public Defender and the Office of Prosecution Services stated that their agency and prosecutors could absorb any new duties under this proposal within current budgets.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal would make it, with some exceptions, unlawful for any person to keep a loaded firearm or an unloaded firearm along with ammunition on any premises under her or his control if the person knows or should have known that a child is capable of gaining access to the firearm without permission of the child's parent or legal guardian.
Violations would be punished by fines of up to $500.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. This legislation would not affect Total State Revenue.
