ASSUMPTION
Officials from the Department of Transportation, Department of Revenue, Office of the State Public Defender, and the Department of Public Safety - Division of Highway Safety and - State Highway Patrol each assume this proposal would not fiscally impact their respective agencies.
Officials from the Office of State Courts Administrator assume the proposed legislation would have no fiscal impact on the courts.
Officials from the Office of Prosecution Services state this proposal can be absorbed by prosecutors.
Officials from the St. Louis Metropolitan Police Department (SLPD) state in 2001, they issued 3,666 summonses for "Failure to Wear Seat Belts" and 410 violations of "Child Restraint Laws." These summonses were a by-product of stopping the vehicle for other reasons. Given the limitations on stopping the vehicle for this purpose, the SLPD sees no significant change in it's policing procedures due to this proposal and accordingly any financial impact would be nominal.
Officials from the Springfield Police Department (SPD) state this proposal would result in a small ticket revenue increase. The SPD also assumed a small labor increase for enforcement, but not significant enough to comment.
Oversight assumes the ticket revenues to local governments will be an insignificant amount.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal would allow a law enforcement officer to enforce the seatbelt law if the officer is able to see the violation without stopping the vehicle.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. This legislation would not affect Total State Revenue.
