FISCAL ANALYSIS

ASSUMPTION

Officials from the Department of Health and Senior Services (DOH) stated the proposed legislation would not be expected to significantly impact the operations of the DOH. If the proposal were to substantially impact the DOH programs, then the DOH would request funding through the legislative process.

Officials from the Department of Agriculture (AGR) assume the proposed legislation would not fiscally impact their organization.

FISCAL IMPACT - Local Government FY 2003

FISCAL IMPACT - Small Business

A positive fiscal impact would be expected for small businesses as they would not be required to construct or maintain separate facilities for manufacturing purposes or meet state licensing and inspection criteria for those facilities. The net fiscal impact is unknown.

DESCRIPTION

This act exempts sellers of jams and jellies from the requirement to construct or maintain separate facilities for their production. This exemption applies as long as the seller does not sell more than $30,000 of jams and jellies annually.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
