ASSUMPTION



Officials of the Office of Prosecution Services stated that there would be no fiscal impact to Prosecutors.



Officials of the Office of State Courts Administrator assume no fiscal impact to the State's courts.

Officials of the Logan-Rogersville Fire Protection District stated that this proposal would not appear to have any further financial impact than statutes, regarding recall of board directors, currently provide.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This act requires that a fire district board member commit some act of misconduct, malfeasance or nonfeasance relating to official board duties, or that the board member be convicted of any felony or any Class A or B misdemeanor, before a registered voter from that district may initiate recall proceedings.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
