ASSUMPTION
Officials from the Missouri Highway Patrol, Missouri Consolidated Health Care Plan, Department of Insurance, Office of Attorney General, Department of Mental Health, Department of Health and Senior Services, and Missouri Department of Conservation assume the proposed legislation would not fiscally impact their organizations.
Officials from the Department of Highways and Transportation (DHT) assume the proposed legislation would have no fiscal impact on MHTC or on the Highway and Patrol Medical Plan.
Officials from the Department of Social Services - Division of Medical Services (DOS-DMS) stated the proposed legislation does not have a fiscal impact to the DMS. Missouri Medicaid reimburses licensed physicians as long as they are enrolled in the Medicaid program. The particular hospital where they provide the services does not determine the payment.
Officials from the Barton County Memorial Hospital, Cass Medical Center, Cooper County Memorial Hospital, Excelsior Springs Medical Center, Lincoln County Memorial Hospital, Pemiscot Memorial Hospital, Phelps County Regional Medical Center, Ray County Memorial Hospital, Samaritan Memorial Hospital, and Ste. Genevieve County Memorial Hospital did not respond to our request for a statement of fiscal impact.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This act prohibits public hospitals from not employing any licensed physician who complies with all hospital rules. Currently, Section 205.300, RSMo, prohibits public hospitals from discriminating against
practitioners of any school of medicine and allows them equal privileges to treat patients. Patient choice of practitioner is also addressed. New language prohibits a public hospital from excluding any physician from employment who is licensed in Missouri, in good standing, and who complies with hospital rules. No hospital may deny, restrict, or terminate medical staff or privileges for unrelated economic reasons. All medical staff applications shall be given due process.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
