FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Transportation, Department of Labor and Industrial Relations, Department of Conservation, Department of Revenue, Department of Economic Development, Department of Insurance, Department of Natural Resources, and the Office of Administration - Administrative Hearing Commission assume the proposed legislation would have no fiscal impact on their agencies.



Officials from the Department of Social Services (DOS) assume the proposed legislation would have application to those cases where litigation attorneys appear before the Administrative Hearings Commission (e.g. Medicaid Rate cases). While having non-attorneys appear in legal proceedings sometimes slows the process, no measurable impact on the length of time to resolve cases is perceived. Therefore, no fiscal impact on DOS agencies is anticipated.

FISCAL IMPACT - Small Business



Small businesses involved in administrative hearings could experience a savings in legal expenses, as they would no longer be required to employ an attorney for such hearings.





DESCRIPTION



This would allow non-attorney officers and employees of businesses to legally represent the business in proceedings before the Administrative Hearing Commission or any state agency.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
