ASSUMPTION



Officials from the Department of Labor and Industrial Relations assume the proposed legislation would have no fiscal impact on their agency.



Officials from the Department of Economic Development (DED) did not respond to our fiscal impact request. However, in response to a similar proposal from a prior session, DED assumed that the proposed legislation would have no fiscal impact on their agency.

FISCAL IMPACT - Small Business



The proposed legislation could impact small businesses within the broadcast industry.





DESCRIPTION



This proposal prohibits television and radio stations and networks from including non-compete clauses in their employment contracts. The proposal does not affect provisions that require an employee to work exclusively for that employer during the length of the contract. The proposal does not apply to sales and management employee contracts. In addition to damages, employers found in violation will be liable for attorneys' fees and costs.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
