ASSUMPTION
Officials of the Department of Economic Development - Public Service Commission and the Department of Economic Development - Office of the Public Counsel stated that the proposal would not have significant fiscal impact on their agencies. They did indicate that skipping the circuit court stage of appeals of Commission orders could free resources for other cases.

FISCAL IMPACT - Small Business
Small business which appealed orders of the Public Service Commission would be affected by this proposal.
DESCRIPTION
This proposal would provide that appeals of Public Service Commission orders be taken directly to the Court of Appeals rather than the Circuit Court. It would also allow orders to be stayed pending appeal and specify the circumstances under which orders could be stayed.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. This legislation would not affect Total State Revenue.
