No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This legislation would prohibit institutions of higher education from providing certain student information to parents. The privileged information would include any information regarding a violation of federal, state or local law or rule, or any institutional rule or policy, regardless of whether such information is contained in the student's education records. The provisions of this section shall not apply if such student is not financially dependent, as defined in the federal Internal Revenue Code, or if the records are requested through subpoena or judicial order. A student may waive this privacy right by signing a consent form with the institution at the beginning of each academic year.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
