FISCAL ANALYSIS



ASSUMPTION



In response to identical legislation, officials from the Office of the State Treasurer and the Office of Administration assumed the proposal would have no fiscal impact on their agencies.



In response to identical legislation, officials from the Department of Public Safety - Missouri Highway Patrol (MHP) assumed the proposed legislation allows funds generated from official use of Highway Patrol vehicles to be deposited to the revolving fund. It also allows funds received as restitution for Patrol vehicle damage or loss to be deposited to the revolving fund.



MHP assumed they receive $50 per day/per car for enforcement in construction zones. If reimbursement of this activity is to be deposited into the revolving fund, it would be a positive impact. However, the exact impact to the fund is unknown because there is no way to predict the extent of restitutions which will be deposited into the fund as a result of damages to Patrol vehicles. The amount received for restitution for damages to Patrol vehicles was in FY 99 and FY 2000 were $5,350 and $1,115 respectively.



Oversight determined that MHP has received reimbursements ($3,288 in FY 2000) for enforcement in construction zones. The reimbursements were deposited into the Federal Funds and tagged as "other" for identification purposes only (the monies are not federal funds). Oversight also determined that restitutions for damage or loss to Patrol vehicles are deposited into the fund from which the vehicle was purchased. Vehicles are purchased from Highway funds, General Revenue, and Gaming funds. Oversight assumes the overall impact to state funds will be zero.

DESCRIPTION



This proposal includes within the Highway Patrol Motor Vehicle and Aircraft Revolving Fund money from the reimbursement of costs for official use of Highway Patrol vehicles and restitution for damages to Highway Patrol vehicles or aircraft.



This legislation is not federally mandated, would not duplicate any other program, and would not require additional capital improvements or rental space.
