FISCAL ANALYSIS



ASSUMPTION



Department of Public Safety officials assume this proposal would have no fiscal impact to their department.



Officials from the Department of Public Safety - Missouri Highway Patrol (MHP) assume this proposal would have no fiscal impact to their agency. In response to a similar proposal from last year, the MHP stated that in most cases the individual is responsible for the cost of training. Few agencies are paying to send an individual through training. Officers must be certified before they can be employed. Officials stated that the costs can vary from $2,700 to $3,500.



In response to a similar proposal from last year, the Johnson County Sheriff assumed that if the 470 hours is required after taking office the cost of training would be paid by the county.



In response to a similar proposal from last year, the Boone County Sheriff assumed no fiscal impact to Boone County.



Oversight assumes that this proposal does not require the affected political subdivision to pay for the cost of training. Therefore, the County Commission's decision to pay the cost of training would be a discretionary act. Oversight assumes no fiscal impact to state or local funds.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.









DESCRIPTION



This proposal changes the training and certification requirements for elected sheriffs beginning January 1, 2002. Currently, elected county sheriffs are exempt from Chapter 590, RSMo, requiring minimum training hours, background check and other requirements of certification by the Director of the Department of Public Safety. This legislation makes elected sheriffs subject to such certification. If the officeholder fails to meet the requirements of Chapter 590, RSMo, the office will be become vacant.



Sheriffs holding office on January 1, 2002, who have not taken 470 hours of basic recruit training are not allowed to participate in primary enforcement activities. Sheriffs not having the 470 hours within eighteen months of election will be removed from office.



Sections establishing a training program after election of sheriffs are deleted. Under this act the training is required prior to election.



The provisions of this act do not apply to the Sheriff of St. Louis City.





This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
