ASSUMPTION



Officials of the Le May Fire Protection District assume there would be a cost of an election to remove a board member.



Officials of the Eureka Fire Protection District stated that this proposal would offer a way of avoiding legal fees, and election costs due to unsubstantiated accusations against seated board members.



Oversight assumes this proposal specifies certain acts that would be the only reason recall action could be initiated against a sitting Fire District Board Member. Oversight assumes current law already provides for a recall election, therefore, there would be no cost of an election. Oversight assumes no state or local fiscal impact.

No direct fiscal impact to small businesses would be expected as a result of this proposal.















DESCRIPTION



This act requires that a fire district board member commit some act of misconduct, malfeasance or nonfeasance relating to official board duties before a registered voter from that district may initiate recall proceedings.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
