FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Natural Resources, Department of Economic Development, Office of Administration - Administrative Hearing Commission, Office of State Courts Administrator, and Department of Social Services stated the proposed legislation would not fiscally impact their organizations.



Officials from the Office of Attorney General (AGO) did not respond to our request for a fiscal impact statement. However, in a similar proposal from the prior session, the AGO officials stated costs could be absorbed due to any additional appeals that could result from the proposed legislation.



Oversight assumes the AGO could absorb the costs associated with any additional appeals that result from the proposed legislation.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



The proposed legislation changes several measures regarding the Administrative Hearing Commission (AHC). The act would require the Department of Social Services to provide notice of a final judgement. The AHC would also be given authority to set reasonable fees in certain cases (motor vehicle and motorcycle franchises). It also removes procedural language found unconstitutional.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
