FISCAL ANALYSIS



ASSUMPTION



Officials from the Office of the Attorney General (AGO) assume costs are unknown to AGO because the effect of this legislation would be to allow additional cases to be brought alleging a procedural defect. Because AGO would defend these additional cases, costs would depend on number of cases brought.



Oversight assumes the number of cases, and thus the cost to defend these cases would be minimal and can be absorbed with existing resources. If a significant number of cases were filed and required additional AGO resources, that cost could be addressed through the budget process.



Officials from the Office of State Courts Administrator, Missouri House of Representatives, and Missouri Senate assume no fiscal impact to their organizations.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal repeals the existing statute of limitations on actions alleging procedural defects in the enactment of legislation. A party claiming to have been harmed by the legislation could then file an action challenging that legislation.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
