FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal provides that political subdivisions, sewer and water districts which own or operate sewer or water systems may require the owners of all houses, buildings, or other facilities within the political subdivisions boundaries, to connect to the sewer system.



This proposal decreases the authorization for the Board of Fund Commissioners to issue bonds for grants and loans pursuant to several sections of Article III of the Missouri Constitution.

The new authorization would affect those sums authorized prior to August 28, 2002.. The authorization decreases are for:



1) Section 644.574 Current authorizations are for twenty million dollars. This proposal reduces the amount to ten million dollars for bonds for rural water, and sewer projects pursuant to Section 37 (g).







2) Section 644.576 Current authorizations are for forty million dollars. This proposal reduces the amount to twenty million dollars for bonds for stormwater control plans, studies and projects in first class counties and the City of St.Louis pursuant to Section 37 (h).



3) Section 644.572 The current authorization of ten million dollars for water pollution control, drinking water system improvements, and stormwater control pursuant to Section 37 (e) remain unchanged. This amount would be in addition to those sums authorized prior to August 28, 2002, rather than the year 2000, which is current law.



Section 644.037 has been amended to require the Department of Natural Resources pursuant to Section 404 of the Federal Clean Water Act and where the U.S. Army Corps of Engineers have determined that a nationwide permit may be utilized, the department shall certify without conditions such nationwide permit as it applies to impacts on waters of the state. Current law makes it applicable to wetlands within the state.



This proposal has an emergency clause.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
