FISCAL ANALYSIS



ASSUMPTION





Officials of the Office of Secretary of State stated that the fiscal impact of this proposal is unknown. The cost would be dependent on election outcomes and the necessity of conducting additional special elections which the state currently pays. Officials assume that the potential for cost would first occur in FY 2003.



Officials of the Kansas City Board of Election Commission stated that the maximum costs for their jurisdiction would be approximately $400,000.



Officials of the Boone County Clerk's Office estimate that run-off costs could cost up to $140,000.



Officials of the Offices of the Cole County Clerk and the Marion County Clerk estimate that this proposal would cost their county as much as $40,000 .



Based on information supplied by the Secretary of State, Oversight, will show costs to the State's General Revenue Fund for reimbursement of election costs to local governments, as $0 to (unknown) beginning in FY 2003 and every other year thereafter. Oversight assumes costs of reimbursement could exceed $100,000 in a given election year.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This act requires run-off elections when no candidate receives more than fifty percent of the votes in either the primary or general election for any federal office, or for the following state offices: Governor, Lieutenant Governor, Secretary of State, Attorney General, State Treasurer, State Auditor, State Senator, State Representative, and certain circuit judgeships. Immediately after the results of the election are announced, the Governor shall order a special election between the top two candidates for an office. The special election shall take place between fourteen and thirty days after the Governor orders the election.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
