No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
The proposed legislation amends two provisions regarding parental liability for damages caused by their children. Currently, a court may order a juvenile or that juvenile's parent to make restitution to the victim of an offense committed by the juvenile, but the restitution is limited to $4,000. The proposal increases this amount to $20,000.
The parent or guardian of any un-emancipated minor (excluding foster parents) against whom a judgment has been rendered for intentional destruction of property shall be liable for payment of the judgment up to $20,000. The amount is currently limited to $2,000.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
