FISCAL IMPACT - Small Business
Small businesses could be affected by this proposal due to the fact that it would expand personal liability immunity for certain volunteers.
DESCRIPTION
The proposed legislation would expand personal liability immunity for certain volunteers. Under current law, a volunteer at a nonprofit organization is not personally liable for damage or injury to the recipient of the service if the volunteer acted in good faith and the injury was not caused by intentional conduct or negligence of the volunteer. This proposal would expand a volunteer's immunity by requiring gross negligence. The proposal would also remove an expired effective date.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
