FISCAL ANALYSIS



ASSUMPTION



Officials of the Department of Economic Development - Office of the Public Counsel indicated that the proposal would not change their agency's duties and would have few fiscal or administrative effects.



Officials of the Department of Economic Development - Public Service Commission stated that the effects of this proposal would not be felt until FY 2005, when the first elected Public Service Commissioners would take office. They noted that the elected Commissioners would serve with the appointed Commissioners until appointee terms expired. From January of 2005 until April of 2005 there would be twelve Commissioners; from April, 2005 through January, 2007, there would be eleven; from January, 2007 through April, 2007, there would be ten; and from April of 2007 forward there would be nine Commissioners.



Department of Economic Development officials estimate costs to implement this proposal would be $621,000 in FY 2005; $985,000 in FY 2006; and $934,000 in FY 2007. Costs for FY 2005 include one-time expenses for equipping new Commissioners and their staff.



Advertisement costs for the proposal would be $4,380 per newspaper column inch for three printings of the text of the proposal, the introduction, title, fiscal note summary, and affidavit. The proposal would be on the ballot for the November 2002 general election.

No direct fiscal impact to small businesses would be expected as a result of this proposal.









DESCRIPTION



This proposal would require that Public Service Commissioners be elected, for four year terms, from congressional districts beginning with the general election of 2004.



The proposal would have appointed Commissioners serve out unexpired terms, stagger terms of elected Commissioners, and provide for qualifications for elected Commissioners.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. The proposal would not affect Total State Revenue.
