ASSUMPTION



Officials from the following agencies assume that costs incurred as a result of the proposed legislation would be zero to minimal and could be absorbed within their respective budgets:

Office of State Courts Administrator, Department of Public Safety-Office of the Director, Missouri Department of Transportation, Department of Public Safety-Office of the Adjutant General, Department of Economic Development, Department of Health, Department of Agriculture, Department of Labor and Industrial Relations, Department of Elementary and Secondary Education, Department of Higher Education, Office of Administration, Department of Public Safety-Missouri State Highway Patrol, Department of Insurance, Office of the Secretary of State, Department of Mental Health, Department of Social Services-Division of Legal Services, and Department of Revenue



Officials from the Office of the Attorney General (AGO) said this proposal could result in additional appeals from Administrative Tribunals if businesses are not represented by attorneys at that phase. Therefore, costs are unknown. Oversight assumes any additional costs would be minimal and could be met from existing resources.

FISCAL IMPACT - Small Business



Small businesses involved in administrative hearings could experience a savings in legal expenses, as they would no longer be required to employ an attorney for such hearings.





















DESCRIPTION



This would allow non-attorney officers and employees of businesses to legally represent the business in proceedings before the Administrative Hearing Commission or any state agency.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
