If this legislation were to result in an increased workload to the department, additional resources would be requested through the normal budget process.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal allows certain wastewater treatment facility projects to be constructed prior to obtaining permit approval from the Department of Natural Resources. Such projects must (1) have a designed daily flow of less than two hundred fifty thousand gallons, (2) be designed to serve no more than five hundred persons and (3) be constructed using less than one million dollars in state grant funds.



This proposal applies to such projects if the applicant files proof of the posting of a performance bond for no less than the projected cost of the project and conditioned on payment if the completed project fails to meet the applicable state effluent discharge requirements.



This proposal provides that the facility may be operated for up to 90 days prior to obtaining

permit approval in order to determine compliance with applicable state effluent discharge requirements.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
