FISCAL ANALYSIS



ASSUMPTION



In response to a similar proposal, officials from the Department of Public Safety -Division of Liquor Control, -Missouri State Water Patrol, and -Peace Officer Standards and Training assume the proposed legislation would have no fiscal impact on their agencies.



Officials from the Department of Public Safety - Missouri Highway Patrol (MHP) - Information Systems Division (ISD) stated that the wording of the legislation would involve significant impact to three applications that ISD supports. The first being the Traffic Arrest and Alcohol and Drug Offense Reporting System (TAS/ADORS); the second being the MHP warning system (HP55) reported on SHP 378; and finally the Drugs and Narcotics system, CJO4. All three of these systems would require major modifications to the input documents, as well as, the data input and stored in the respective data base systems. The changes would be significant enough that the applications themselves would require complete re-engineering (re-writing).



Adequate technical staff will have to be provided to ISD to design, develop, test, maintain, support, and document the programs and to maintain and improve the application systems involved. Additional effort will be required for the development and support of the annual reporting to the Attorney General. ISD assumes it will require:



CITS I (Developer) for Traffic Arrests (TAS/ADORS) $40,536

CITS I (Developer) (HP55 Warnings and SHP 37B) $40,536

CITS I (Developer) (CJ04 - Drugs and Narcotics Portion for "contraband") $40,536

Total for CITS I positions $121,608



These positions would require the standard office equipment. The Patrol's Training Division assumes that all training required will be combined with annual training that is currently done.



The patrol would redesign the existing activity report (SHP 378) to include all of the required data. There would not be a cost for redesigning it. However, the Patrol's Budget and Procurement Division would be responsible for reprinting the redesigned activity reports (SHP 378). The cost would be approximately $5,000.

Oversight assumes the applications would have to be modified by August 28, 2000 to meet the requirements of this proposal; therefore, we assume ISD will utilize current staff to design, develop, test, maintain, support, and document the programs.



Officials from the Office of Attorney General assume they will require 1 FTE Paralegal plus the related expense and equipment to analyze annual reports and compile reports.



ASSUMPTION (continued)



Officials from the Department of Conservation assume the proposed legislation would have minor fiscal impact on their agency since officers do not routinely stop traffic violators.



Officials from the Department of Natural Resources (DNR) assume the proposed legislation requires collection and reporting of racial information during traffic stops. Most of the information addressed in this proposal is obtained when the department's Rangers issue citations and/or make arrests. However, not all of the information required by this proposal is obtained when Rangers conduct traffic stops and issue written or verbal warnings. As a result of the proposal, the Ranger Program will need to develop an operating policy and a report form to ensure the necessary information is captured consistently.



In addition, Rangers will need to attend specific training to ensure they obtain the accurate information in a legal and consistent manner. The department assumes the Ranger Program staff in Central Office would need to enter the information gathered into a database, maintain the database, and ensure the information is reported to the attorney general no later than March 1st of the following year.



The department assumes there may be costs related to the implementation of this proposal; however, these costs cannot be determined at this time.



Oversight assumes DNR can absorb any additional workload associated with this proposal.



Oversight assumes the proposal will impact local law enforcement agencies as they will be required to collect, compile, and report annually to the attorney general the information required by the proposal.

FISCAL IMPACT - Small Business



No direct fiscal impact on small businesses would be expected due to this proposal.





DESCRIPTION



The proposed legislation requires each law enforcement agency to adopt a policy on race-based traffic stops and to report statistics to the Office of the Attorney General.



HA 1 to PT 3 allows each county and city not within a county to establish a civilian review board.



This legislation is not federally mandated, would not duplicate any other program, and would not require additional capital improvements or rental space.
