FISCAL ANALYSIS



ASSUMPTION



Officials of the Department of Health, the Department of Mental Health, and the Department of Social Services indicated that this proposal would not affect their agencies.



Officials of the Department of Elementary and Secondary Education indicated that the proposal would not have any fiscal effect on their Department. They did note that sheltered workshops currently receive about $9 million, statewide, from taxes authorized in section 205.971. They assumed that additional duties for workshops could cost them, collectively, up to the $9 million.



Oversight assumes that because the proposal does not have any additional sources of money for sheltered workshops, the workshop boards would have to allocate existing resources to carry out duties related to the proposal.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This proposal would require SB 40 boards (sheltered workshop boards) to conduct, or contract to have conducted, annual assessments of needs of the developmentally disabled, their families and their communities. It would require that rules for admissions to workshops be those developed by the Department of Elementary and Secondary Education. It would also change the definition of "developmental disability" and change references to "handicapped persons" to references to developmentally disabled persons" in sections 205.968 through 205.973

This proposal contains an emergency clause.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. This proposal would not affect Total State Revenue.
