ASSUMPTION
The Department of Conservation (MDC), the Missouri State Highway Patrol and the Office of Prosecution Services assume they would not be impacted by this proposal.
The State Courts Administrator (CTS) estimates that there are approximately 3,500 wildlife related cases filed every year, but they have no way to estimate the number of convictions or the subsequent filings for expungement. However, they do not expect the number of expungements to significantly impact the workload of the courts.
Additionally, expungements are civil court actions and a full set of civil fees is collected on each case. Therefore, this legislation could affect state revenues with respect to the Clerk Fee ($36 to state General Revenue) and the Court Automation Fund Fee ($7 to the Court Automation Fund). CTS does estimate that approximately 200 cases per year could be filed and involve the payment of these civil fees.
This proposal could result in income to the General Revenue Fund and the Court Automation Fund; therefore, the proposal could result in an increase to Total State Revenues.

DESCRIPTION
This legislation changes the penalties for hunting violations and expunges misdemeanor convictions after three years.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
