ASSUMPTION
Officials from the Department of Health, Office of State Courts Administrator and Laclede County Circuit Clerk and Recorders Office assume that this proposal will not fiscally affect their agencies.
Officials from the Office of City of St. Louis Recorder of Deeds stated that the marriage license application as provided by the Department of Health - Bureau of Vital Records includes an oath that the applicants are free to marry under the laws of the state. The application is signed by the applicants. A separate affidavit would create a cost to most Recorders for computer consultants and programming. The City of St. Louis Recorder of Deeds believes that this would result in a duplication of duties. The City of St. Louis Recorder of Deeds did not provide an estimate of costs associated with this proposal.
Oversight assumes the additional sworn affidavit could be processed by existing staff within the various Recorder of Deeds offices throughout the state. Therefore, no local government costs will be presented in the fiscal note. The proposal does not modify the filing fee for the marriage license, therefore, no revenue is associated with this proposal.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal requires applicants for marriage to present a sworn affidavit stating that the applicants are single, or if previously married, are now divorced.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
